Ltd.<\/em>, \u00a0[2015-1016, 2015-1018, 2015-1019] (May 26, 2016), the Federal Circuit affirmed the\u00a0district court&#8217;s construction of &#8220;mountable,&#8221; and thus summary judgment of non-infringement.<\/p>\n<p>At issue was U.S. Patent No. 6,975,308, which discloses a mountable digital<br \/>\npicture frame for displaying still digital images, and in particular the claim language &#8220;\u201ca mountable picture\u00a0frame adapted to digitally display at least one still image\u00a0thereon,\u201d which Profectus as asserting against certain tablet devices with stands. \u00a0The district court\u00a0concluded that \u201cthe picture frame or display must have some intrinsic mounting feature\u2014not just a\u00a0feature that could potentially render the frame or display\u00a0capable of being mounted.\u201d<\/p>\n<p>Profectus argued on appeal that &#8220;mountable&#8221; meant capable of being mounted, while defendants argued that the fact that\u00a0a device is\u00a0capable of mounting does not make it \u201cmountable.\u201d The Federal Circuit agreed with defendant, noting that the term \u201cmountable\u201d is a modifying word in the\u00a0claims: \u201cmountable picture display,\u201d &#8220;mountable picture frame,\u201d \u00a0\u201cwall\u00a0mountable,\u201d and \u201cdesk top mountable.\u201d \u00a0The Federal Circuit observed that absent from the claims are words that\u00a0embrace broader meaning, such as \u201ccapable of,\u201d \u201cadapted\u00a0to,\u201d or \u201cconfigured to.\u201d The claim language is tailored to,\u00a0characterizes, and delimits the claimed \u201cpicture frame\u201d\u00a0and \u201cpicture display.\u201d The Federal Circuit further noted that the specification\u00a0does not disclose a bare embodiment in which the picture\u00a0display or picture frame lacks a feature for mounting.<\/p>\n<p>By\u00a0noting that the picture display or frame must have some\u00a0intrinsic mounting feature, the district court correctly,\u00a0specification,\u00a0that the picture display or frame must include\u00a0something that may be used for mounting the device.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In\u00a0Profectus Technology LLC v.\u00a0Huawei Technologies Co.
