{"id":815,"date":"2016-04-29T08:19:43","date_gmt":"2016-04-29T12:19:43","guid":{"rendered":"https:\/\/patents.harnessip.com\/?p=815"},"modified":"2016-04-29T08:19:43","modified_gmt":"2016-04-29T12:19:43","slug":"an-illuminating-discussion-about-design-patents","status":"publish","type":"post","link":"https:\/\/patents.harnessip.com\/?p=815","title":{"rendered":"An Illuminating Discussion About Design Patents"},"content":{"rendered":"<p>Design patents protect the aesthetic appearance of a product or portion of the product. \u00a0The aesthetic appearance is affected by a number of things, including whether the product is illuminated. \u00a0However, how does one capture in the USPTO&#8217;s preferred black and white line drawings that fact that some or all of the design is illuminated? \u00a0Pretty much the way you would think. \u00a0Take, for example, U.S. Patent No. D688245 on a Contoured Mouse, which illustrates illumination with a burst of radiating dashed lines:<\/p>\n<p><a href=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D688245.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" size-full wp-image-816 aligncenter\" src=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D688245.jpg\" alt=\"D688245\" width=\"739\" height=\"588\" srcset=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D688245.jpg 739w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D688245-300x239.jpg 300w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D688245-377x300.jpg 377w\" sizes=\"auto, (max-width: 739px) 100vw, 739px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>the patent explains that the &#8220;dash-dot-dash lines shown in Fig 8 represent the illumination at the finger wheel and these lines form no part of the claimed design.&#8221; \u00a0This same technique was used in U.S. Patent No. D688,664, also on a contoured mouse.<\/p>\n<p>Discover Financial Service used a similar technique to illustrate an illuminated portion on their Discover Card in U.S. Patent No. D685419:<\/p>\n<p><a href=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D685419.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-817\" src=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D685419.jpg\" alt=\"D685419\" width=\"831\" height=\"639\" srcset=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D685419.jpg 831w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D685419-300x231.jpg 300w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2016\/04\/D685419-390x300.jpg 390w\" sizes=\"auto, (max-width: 831px) 100vw, 831px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>The patent explaining that &#8220;The circle is the boundary of the illuminated portion. \u00a0The radiating lines illustrate the glow of the illumination.&#8221;
