{"id":75,"date":"2014-02-10T10:51:38","date_gmt":"2014-02-10T15:51:38","guid":{"rendered":"https:\/\/patents.harnessip.com\/?p=75"},"modified":"2014-02-10T14:40:28","modified_gmt":"2014-02-10T19:40:28","slug":"its-what-you-claim-not-what-you-meant-to-claim-that-counts","status":"publish","type":"post","link":"https:\/\/patents.harnessip.com\/?p=75","title":{"rendered":"It&#8217;s What You Claim, Not What You Meant to Claim, That Counts"},"content":{"rendered":"<p>On February 7, 2014, Magistrate Thynge issued a report and recommendation in\u00a0 Magnetar Technologies Corp. v Six Flags Theme Parks, Inc., 07-127-LPS-MPT (D.Del) that among other things found Claim 3 of U.S. Patent No. 5,277,125 invalid for indefiniteness.\u00a0 Claim 3 states:<\/p>\n<p><a href=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/US-5277125-Claim-32.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-79\" title=\"US 5277125 - Claim 3\" src=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/US-5277125-Claim-32.jpg\" alt=\"\" width=\"666\" height=\"646\" srcset=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/US-5277125-Claim-32.jpg 666w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/US-5277125-Claim-32-300x290.jpg 300w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/US-5277125-Claim-32-309x300.jpg 309w\" sizes=\"auto, (max-width: 666px) 100vw, 666px\" \/><\/a><\/p>\n<p>The problem is that Claim 3 specifies <em>a<\/em> track, but then calls for magnet assemblies between <em>said tracks<\/em>.\u00a0 The inventor testitifed that he\u00a0knew what it\u00a0meant:<\/p>\n<p><a href=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/Testimony.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-80\" title=\"Testimony\" src=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/Testimony.jpg\" alt=\"\" width=\"1246\" height=\"277\" srcset=\"https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/Testimony.jpg 1246w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/Testimony-300x66.jpg 300w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/Testimony-1024x227.jpg 1024w, https:\/\/patents.harnessip.com\/wp-content\/uploads\/2014\/02\/Testimony-500x111.jpg 500w\" sizes=\"auto, (max-width: 1246px) 100vw, 1246px\" \/><\/a><\/p>\n<p>But it did not\u00a0<em>say<\/em> what he meant.\u00a0 This is reminsecent of <em>Chef America v. Lamb Weston<\/em>, 358 F.3d 1371 (Fed. Cir. 2004) where the claim &#8220;heating to&#8221; rather than &#8220;heating at&#8221; 450\u00b0 proved fatal to the patent.<\/p>\n<p>There were serveral possible fixes, none of which were made.\u00a0 Precisely because there were\u00a0serveral fixes, Magistrate Thynge found that correction would be subject to reasonable debate, so that Court was unable to\u00a0correct the error under <em>Novo Indus., L.P. v. Micro Molds Corp.<\/em>, 350 F.3d 1348, 1354 (Fed.
