{"id":744,"date":"2016-04-05T23:03:24","date_gmt":"2016-04-06T03:03:24","guid":{"rendered":"https:\/\/patents.harnessip.com\/?p=744"},"modified":"2016-04-05T23:05:30","modified_gmt":"2016-04-06T03:05:30","slug":"bri-should-not-depart-from-departure-from-what-the-claim-language-and-specification-so-clearly-mean","status":"publish","type":"post","link":"https:\/\/patents.harnessip.com\/?p=744","title":{"rendered":"BRI Should Not Depart from What the Claim Language and Specification so Clearly Mean"},"content":{"rendered":"<p>In <em>Pride Mobility Products Corporation v, Permobil, Inc.<\/em>, [2015-1585, -1586] (April 5, 2016), the Federal Circuit reversed the PTAB&#8217;s construction and cancellation of claim 7, but affirmed cancellation of all the other claims of U.S. Patent Nos. 8,408,598 and 8,408,343 in\u00a0IPR2013-00407 and\u00a0IPR2013-00411.<\/p>\n<p>At issue was the claim language\u00a0\u201cmounting plate [that] is substantially planar and is<br \/>\noriented perpendicular to the drive wheel axis.\u201d \u00a0The Federal Circuit said it was <em>unreasonable<\/em> to read\u00a0that straightforward language as meaning anything other<br \/>\nthan that the drive-wheel axis is perpendicular to the\u00a0surface of the mounting plate that makes the plate substantially\u00a0planar. \u00a0The Federal Circuit explained:<\/p>\n<blockquote><p>The claim language says two things about the plate: it\u00a0must be substantially planar, and it must be oriented perpendicular to the drive-wheel axis. The \u201coriented\u201d\u00a0term allows the plate and axis not to be touching: it\u00a0requires that their placement in space must be such that,\u00a0if translated in space without rotation, they would be\u00a0perpendicular. With the axis idealized as a line, perpendicularity\u00a0in the ordinary geometric sense relevant here\u00a0requires that the axis make a right angle with either an\u00a0essentially one-dimensional feature (a line or curve) or an\u00a0essentially two-dimensional feature (a plane or surface) of\u00a0the plate: lines are not \u201cperpendicular\u201d to a three dimensional\u00a0object in any other ordinary geometric sense. \u00a0And the claim tells us exactly what that feature of the three-dimensional plate is: it is the surface that makes\u00a0the plate substantially planar. The claim identifies no\u00a0other feature of the plate. The phrase \u201coriented perpendicular\u00a0to the drive wheel axis\u201d must be read to mean that\u00a0the drive-wheel axis is perpendicular to the mounting plate\u2019s substantially planar surface. We do not see how\u00a0the claim language can mean anything else without\u00a0obvious strain.<\/p><\/blockquote>\n<p>The Federal Circuit said that the Board\u2019s sole basis for its claim construction does<br \/>\nnot reasonably support a departure from what the claim\u00a0language and specification so clearly mean. There was no evidence of the\u00a0claim 7 element in the relied-on prior art.
