{"id":448,"date":"2016-02-04T15:51:40","date_gmt":"2016-02-04T20:51:40","guid":{"rendered":"https:\/\/patents.harnessip.com\/?p=448"},"modified":"2016-02-04T15:51:40","modified_gmt":"2016-02-04T20:51:40","slug":"regarding-beauregarding","status":"publish","type":"post","link":"https:\/\/patents.harnessip.com\/?p=448","title":{"rendered":"Regarding  Beauregarding"},"content":{"rendered":"<p>A Beauregard claim\u00a0\u00a0is a\u00a0claim to\u00a0a computer program written as a claim to an\u00a0article of manufacture: a computer-readable medium on which instructions are encoded\u00a0for carrying out a process.\u00a0 Beauregard appealed the rejection of his claims directed to software on a tangible storage medium.\u00a0 The Court never approved this method of claiming software, because\u00a0the Commissioner of Patents conceded that &#8220;that computer programs embodied in a tangible medium, such as floppy diskettes, are patentable subject matter under 35 U.S.C. \u00a7 101 and must be examined under 35 U.S.C. \u00a7 102 and 103,&#8221; and dismissed the appeal In re Beauregard, 53 F.3d 1583 (Fed. Cir. 1995).<\/p>\n<p>This worked well until In re Nuijten, <span class=\"reference-text\">500 F.3d 1346 (Fed. Cir. 2007), where the\u00a0Federal Circuit held that signals were not patent eligible, because their ephemeral nature kept them from falling within the statutory categories of 35 U.S.C. \u00a7\u00a0101.\u00a0\u00a0This undermined \u00a0Beauregard claims to computer programs electronically distributed.\u00a0 In 2010, the USPTO advised applicants that, to avoid running afoul of In re Nuijten,\u00a0software claims should be directed to <strong><em>non-transitory<\/em><\/strong>\u00a0computer-readable media.<\/span><\/p>\n<p><span class=\"reference-text\">However, the USPTO&#8217;s wording\u00a0may be problematic, because rewritable storage media such as flash drives, are regarded by at least some as &#8220;transitory.&#8221; To resolve this potential issue with the USPTO&#8217;s non-transitory\u00a0computer-readable media, it may behoove the applicant to provide an explanation or definition of &#8220;non-transitory&#8221; that does not exclude legitimate tangible temporary storage media.\u00a0 For example,\u00a0 this language from recently issued U.S. Patent No. 9113131:<\/span><\/p>\n<blockquote><p>Generally speaking, a computer-accessible medium may include any tangible or non-transitory storage media or memory media such as electronic, magnetic, or optical media\u2014e.g., disk or CD\/DVD-ROM coupled to computer system\u00a0400\u00a0via bus\u00a0430. The terms \u201ctangible\u201d and \u201cnon-transitory,\u201d as used herein, are intended to describe a computer-readable storage medium (or \u201cmemory\u201d) excluding propagating electromagnetic signals, but are not intended to otherwise limit the type of physical computer-readable storage device that is encompassed by the phrase computer-readable medium or memory. For instance, the terms \u201cnon-transitory computer-readable medium\u201d or \u201ctangible memory\u201d are intended to encompass types of storage devices that do not necessarily store information permanently, including for example, random access memory (RAM). Program instructions and data stored on a tangible computer-accessible storage medium in non-transitory form may further be transmitted by transmission media or signals such as electrical, electromagnetic, or digital signals, which may be conveyed via a communication medium such as a network and\/or a wireless link.<\/p><\/blockquote>\n<p>U.S. Patent No. 9110963 explains:<\/p>\n<blockquote><p>The terms \u201ctangible\u201d and \u201cnon-transitory,\u201d as used herein, are intended to describe a computer-readable storage medium (or \u201cmemory\u201d) excluding propagating electromagnetic signals, but are not intended to otherwise limit the type of physical computer-readable storage device that is encompassed by the phrase computer-readable medium or memory.
