Vidal<\/em>, <a href=\"https:\/\/cafc.uscourts.gov\/opinions-orders\/22-1548.OPINION.12-15-2023_2238874.pdf\">[2022-1548]<\/a> (December 15, 2023) the Federal Circuit affirmed the PTAB\u2019s determination that claim 3 of U.S. Patent No. 7,110,444 was unpatentable as obvious.<\/p>\n\n\n\n<p>At issue on appeal was the construction of \u201cstorage element.\u201d The Federal Circuit noted that in the \u2018551 patent, incorporated by reference into the \u2018444 patent, Parkervision acted as its own lexicographer to define the term \u201cstorage element.\u201d The language expresses an intent to define the term \u201cstorage element.\u201d&nbsp; In particular the Federal Circuit said that the patentee\u2019s use of the phrases \u201cas used herein\u201d and \u201crefer to\u201d conveys an intent for sentence 5 to be definitional.\u201d&nbsp; The language was found definitional because it did not refer to reference numerals, and referring to the document as a whole with the phrase \u201cas used herein.\u201d<\/p>\n\n\n\n<p>The Federal Circuit found that the Board\u2019s construction of \u201cstorage element\u201d\u2014\u201can element of a system that stores non-negligible amounts of energy from an input EM signal\u201d\u2014 correctly tracks the lexicography provided in the specification.\u00a0 Agreeing with the PTAB\u2019s claim construction, the Federal Circuit affirmed their obviousness determination as well.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Parkervision, Inc., v.
