{"id":2157,"date":"2018-08-03T10:41:21","date_gmt":"2018-08-03T14:41:21","guid":{"rendered":"https:\/\/patents.harnessip.com\/?p=2157"},"modified":"2018-08-03T10:41:21","modified_gmt":"2018-08-03T14:41:21","slug":"in-search-of-the-end-determining-the-expiration-date-of-a-utility-patent","status":"publish","type":"post","link":"https:\/\/patents.harnessip.com\/?p=2157","title":{"rendered":"In Search of the End: Determining the Expiration Date of a Utility Patent"},"content":{"rendered":"<p>Calculating the expiration date of a U.S. Utility Patent is not particularly difficult, but it can be confusing &#8212; so confusing in fact that the U.S. Government occasionally blows it &#8212; see U.S. Patent No. 7,604,811, which issued long after it expired.<\/p>\n<p>For patent issuing from applications filed before June 8, 1995, the term is the longer of 17 years from issue, or 20 years form its earliest effective filing date (pursuant to 35 USC 154(a)(2)).\u00a0 That&#8217;s more than 20 years ago &#8212; who cares?\u00a0 Applications filed before June 8, 1995, are still pending.\u00a0 U.S. Patent No. 10,016,914 on\u00a0Positive Displacement Molding of Plastic Parts issued on July 10, 2018, and five such patents issued in 2017.\u00a0 Although rare, it is still a possibility that must be taken into account.<\/p>\n<div id=\"container\" class=\"container\">\n<div id=\"container-inner\" class=\"pkg\">\n<div id=\"pagebody\">\n<div id=\"pagebody-inner\" class=\"pkg\">\n<div id=\"beta\">\n<div id=\"beta-inner\" class=\"pkg\">\n<div id=\"tpc-comments\">\n<div class=\"comments-content\">\n<div id=\"tpc_thread\">\n<div id=\"tpe-content\">\n<div id=\"tpe-comments-content\" class=\"no-avatar\">\n<div id=\"comment-6a011278dee4f428a40120a6a058ae970c\" class=\"comment font-entrybody comment-by-owner comment-has-number\">\n<div class=\"comment-data\">\n<div class=\"comment-content\">\n<p>The vast majority are governed by 35 USC 154(a)(2), which provides:<\/p>\n<blockquote><p>Subject to the payment of fees under this title, such grant shall be for a term beginning on the date on which the patent issues and ending 20 years from the date on which the application for the patent was filed in the United States or, if the application contains a specific reference to an earlier filed application or applications under section 120, 121, or 365(c) of this title, from the date on which the <i>earliest<\/i> such application was filed.<\/p><\/blockquote>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"container\" class=\"container\">\n<div id=\"container-inner\" class=\"pkg\">\n<div id=\"pagebody\">\n<div id=\"pagebody-inner\" class=\"pkg\">\n<div id=\"beta\">\n<div id=\"beta-inner\" class=\"pkg\">\n<div id=\"entry-6a011278dee4f428a40120a60b7bd7970b\" class=\"entry-category-army entry-category-lengthy_prosecutions entry-category-prosecution_styles entry-author-aaron_feigelson entry-type-post entry\">\n<div class=\"entry-inner\">\n<div class=\"entry-content\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>Simply stated, you take the earliest effective filing for the patent (other than a provisional application filing date or a foreign filing date and add 20 years.\u00a0 However three adjustments must be considered.
