{"id":1940,"date":"2018-01-25T14:34:20","date_gmt":"2018-01-25T19:34:20","guid":{"rendered":"https:\/\/patents.harnessip.com\/?p=1940"},"modified":"2018-02-03T14:54:48","modified_gmt":"2018-02-03T19:54:48","slug":"second-and-third-bites-at-the-apple-subsequent-ipr-losses-undo-ipr-win","status":"publish","type":"post","link":"https:\/\/patents.harnessip.com\/?p=1940","title":{"rendered":"Second and Third Bites at the Apple; Subsequent IPR Losses undo IPR Win"},"content":{"rendered":"<p>In <a href=\"http:\/\/www.cafc.uscourts.gov\/sites\/default\/files\/opinions-orders\/17-1039.Opinion.1-23-2018.1.PDF\">Maxlinear, Inc. v.\u00a0CF Crespe LLC<\/a>, [2017-1039] (January 25, 2018), the Federal Circuit\u00a0we vacated and remanded the PTAB&#8217;s determination that dependent claims were not unpatentable\u00a0 in view of the Federal Circuit&#8217;s intervening affirmance of a second IPR that claims 1 and 17 unpatentable.<\/p>\n<p>The case involved U.S. Patent No. 7,075,585 on a broadband television signal<br \/>\nreceiver for receiving multi-standard analog television\u00a0signals, digital television signals and data channels.\u00a0 The Board found the only two independent claims 1 and 17 were not shown to be unpatentable, and thus did not reach the patentability of the dependent claims.<\/p>\n<p>The Federal Circuit held that the two IPR&#8217;s that found claims 1 and 17 unpatentable, were binding &#8220;as a matter of collateral estoppel&#8221; in this case.\u00a0\u00a0The fact that the other IPR&#8217;s became final while this\u00a0case was pending on appeal is irrelevant.\u00a0\u00a0The preclusive effect of the prior adjudications, and\u00a0subsequent affirmations, has finally resolved the issue of\u00a0the unpatentability of independent claims 1 and 17 and\u00a0dependent claim 20 in this proceeding.
