{"id":1780,"date":"2017-09-13T18:37:41","date_gmt":"2017-09-13T22:37:41","guid":{"rendered":"https:\/\/patents.harnessip.com\/?p=1780"},"modified":"2017-10-02T19:16:57","modified_gmt":"2017-10-02T23:16:57","slug":"foreign-suits-involving-foreign-patents-do-not-create-a-case-or-controversy-in-the-u-s","status":"publish","type":"post","link":"https:\/\/patents.harnessip.com\/?p=1780","title":{"rendered":"Foreign Suits Involving Foreign Patents Do Not Create a Case or Controversy in the U.S."},"content":{"rendered":"<p>In <a href=\"http:\/\/www.cafc.uscourts.gov\/sites\/default\/files\/opinions-orders\/16-2641.Opinion.9-11-2017.1.PDF\">Allied Mineral Products, Inc. v.\u00a0OSMI, Inc.<\/a>, [2016-2641] (September 13, 2017), the Federal Circuit affirmed the dismissal of Allied&#8217;s declaratory judgment action\u00a0seeking a declaration that\u00a0Stellar\u2019s\u00a0U.S. Patent No. 7,503,974\u00a0is invalid, and that Stellar committed inequitable conduct, for lack of\u00a0subject matter jurisdiction.<\/p>\n<p>This dispute centered on a Mexican infringement suit\u00a0between Stellar and two of Allied\u2019s Mexican distributors.\u00a0 Allied manufactured the accused product\u00a0in the\u00a0United States, which are then sold in Mexico by Allied\u2019s Mexican distributors.\u00a0\u00a0The district court held\u00a0that Stellar\u2019s decision to enforce its Mexican patent\u00a0under Mexican law against separate entities cannot,\u00a0without further affirmative action by Stellar, create an<br \/>\nactual controversy with Allied with regard to its U.S. patent.<\/p>\n<p>The Federal Circuit reasoned that\u00a0the totality of the circumstances in this case does not\u00a0rise to the level of a case of actual controversy. Declaratory\u00a0judgment jurisdiction requires some affirmative act by<br \/>\nthe patentee, and Stellar has not\u00a0directed any actions towards Allied, nor has it litigated or\u00a0threatened litigation in the United States or on its U.S.<br \/>\npatent.<\/p>\n<p>Allied argued that it has been forced into an unwinnable\u00a0business position; it can either continue to sell products in\u00a0the United States knowing it may be the target of an\u00a0infringement suit, or it can cease selling products it\u00a0believes it has a right to sell.
