Guardian Protection Services, Inc.<\/em><\/a>, [2016-2521] (June 5, 2017), the Federal Circuit reversed and remanded the determination that\u00a0Appellee Rothschild\u00a0Connected Devices Innovations, LLC had\u00a0not engaged in conduct sufficient to make the litigation\u00a0\u201cexceptional.\u201d<\/p>\n<p>Rothschild\u2019s sued ADS, alleging that ADS\u2019s home security system\u00a0infringes U.S. Patent No. 8,788,090. \u00a0ADS responded that the\u00a0\u2019090 patent covers patent ineligible\u00a0subject matter under 35 U.S.C. \u00a7 101, and that\u00a0prior art anticipates claim 1 of the \u2019090 patent, an offered to settle if Rothschild paid ADS its attorneys fees and costs of $43,330. \u00a0When Rothschild rejected the offer,\u00a0ADS next filed a motion for judgment on the pleadings, and sent Rothschild a \u201cSafe Harbor Notice\u201d pursuant to Federal\u00a0Rule of Civil Procedure 11(c)(2). \u00a0In response,\u00a0Rothschild voluntarily moved to dismiss its action, and ADS opposed the motion and filed a cross-motion for attorneys fees pursuant to \u00a7 285.<\/p>\n<p>The District Court granted Rothschild\u2019s\u00a0Motion to Dismiss and denied ADS\u2019s Cross-Motion for\u00a0attorneys&#8217; fees, finding that Rothschild did<br \/>\nnot engage in conduct sufficient to make the action \u201cexceptional\u201d<br \/>\nunder \u00a7 285, noting that\u00a0Rothschild\u2019s decision to voluntarily withdraw its<br \/>\ncomplaint within the safe harbor period is the type of\u00a0reasonable conduct Rule 11 is designed to encourage.<\/p>\n<p>The Federal Circuit found the denial of attorneys&#8217; fees was an abuse of discretion. \u00a0The Federal Circuit found that the district court\u00a0clearly erred by failing to consider\u00a0Rothschild\u2019s willful ignorance of the prior art. \u00a0The Federal Circuit further found that the district court misjudged Rothschild\u2019s conduct in the other litigation is brought. \u00a0Finally the Federal Circuit found that the district court\u00a0improperly conflated Rule 11 with\u00a035 U.S.C. \u00a7 285.<\/p>\n<p>The Federal Circuit remanded the case for further consideration of the attorneys&#8217; fees reward by the district court.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Rothschild Connected Devices \u00a0Innovations, LLC v.
