{"id":1559,"date":"2017-05-10T13:45:22","date_gmt":"2017-05-10T17:45:22","guid":{"rendered":"https:\/\/patents.harnessip.com\/?p=1559"},"modified":"2017-05-21T13:58:16","modified_gmt":"2017-05-21T17:58:16","slug":"merely-because-petitioner-changes-its-mind-is-not-enough-to-stop-inter-partes-reexamination","status":"publish","type":"post","link":"https:\/\/patents.harnessip.com\/?p=1559","title":{"rendered":"Merely Because Petitioner Changes its Mind is not Enough to Stop Inter Partes Reexamination"},"content":{"rendered":"<p>In\u00a0<a href=\"http:\/\/www.cafc.uscourts.gov\/sites\/default\/files\/opinions-orders\/16-1830.Opinion.5-8-2017.1.PDF\">In Re: AT&amp;T Intellectual Property II, L.P.<\/a>, [2016-1830] (May 10. 2017), the Federal Circuit affirmed the PTAB determination\u00a0in inter partes reexamination, that the claims of U.S. Patent No. 7,454,071, directed to\u00a0methods of compressing and\u00a0transmitting digital video data, were invalid.<\/p>\n<p>On appeal, AT&amp;T argued that it was improper to institute inter partes reexamination, when the petitioner requested that its petition be denied. \u00a0The Federal Circuit found that institution was proper. \u00a0AT&amp;T also argued that the claims were not anticipated, and the Federal Circuit concluded that the Board\u2019s finding of\u00a0anticipation is supported by substantial evidence. \u00a0Finally AT&amp;T argued that the Examiner improperly changed the basis for the anticipation rejection. \u00a0The Federal Circuit found that AT&amp;T had notice of the the second basis for finding anticipation, and still did not amend the claims to respond to this second basis.<\/p>\n<p>Concluding that the finding of anticipation was supported by substantial<br \/>\nevidence, the Board affirmed.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In\u00a0In Re: AT&amp;T Intellectual Property II, L.P., [2016-1830] (May 10. 2017), the Federal Circuit affirmed the PTAB determination\u00a0in inter partes reexamination, that the claims of U.S. Patent No. 7,454,071, directed to\u00a0methods of compressing and\u00a0transmitting digital video data, were invalid.
