Power Integrations, Inc.<\/em><\/a>, [2017-1002] the Federal Circuit remanded the appeal from a PTAB decision in an <em>inter partes<\/em> reexamination, with direction to\u00a0vacate certain aspects of its final<br \/>\ndecision in the underlying <em>inter partes<\/em> reexamination and\u00a0issue a reexamination certificate.<\/p>\n<p>Fairchild sued Power Integrations for infringement of U.S. Patent No. 7,259,972. The jury\u2019s\u00a0verdict rejected Power Integrations\u2019s argument that the\u00a0\u2019972 patent claims were invalid under 35 U.S.C. \u00a7 103, and found that the\u00a0patent claims had been infringed. On appeal, the Federal Circuit affirmed the\u00a0jury\u2019s non-obviousness determination but reversed its findings on infringement, and remanded for further proceedings unrelated to the \u2019972 patent claims.<\/p>\n<p>While the litigation was pending, Power Integrations requested <em>inter partes<\/em> reexamination of the &#8216;972 patent. \u00a0The Examiner\u00a0rejected all of the claims in the reexamination under \u00a7103(a), and the Board affirmed, resulting in the instant appeal.<\/p>\n<p>Fairchild argued that the results of the reexamination proceeding\u00a0should be vacated under\u00a0\u00a7317(b) because the final decision in the litigation bars the maintenance of the reexamination. \u00a0The Federal Circuit agreed, noting that the time for petitioning for <em>certiorari<\/em> had passed, and thus the district court&#8217;s holding that the patent was not invalid barred the maintenance of the reexamination as to the claims challenged in the litigation.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Fairchild Corporation v.
