Google, Inc.<\/em>, [2016-1755] (March 7, 2017), the Federal Circuit affirmed the PTAB determination that claims 16, 17, 19 and 20 of U.S. Patent No. 8,156,096 on a\u00a0system whereby a<br \/>\nuser can identify a supplier of goods or services over the<br \/>\nInternet, were invalid for obviousness.<\/p>\n<p>The Federal Circuit began with the observation that\u00a0a combination of known elements is likely to be obvious\u00a0when it yields predictable results. The Federal Circuit observed that obviousness may<br \/>\nbe defeated if the prior art indicates that the invention<br \/>\nwould not have worked for its intended purpose or otherwise<br \/>\nteaches away from the invention. The Federal Circuit explained\u00a0that\u00a0a\u00a0reference teaches away \u201cwhen a\u00a0person of ordinary skill, upon reading the reference,\u00a0would be discouraged from following the path set out in\u00a0the reference, or would be led in a direction divergent\u00a0from the path that was taken\u201d in the claim. However \u00a0a\u00a0reference that \u201cmerely expresses a general\u00a0preference for an alternative invention but does not\u00a0criticize, discredit, or otherwise discourage investigation\u00a0into\u201d the claimed invention does not teach away.<\/p>\n<p>Although Meiresonne argued that the references taught away from the combination of descriptive text and a\u00a0rollover viewing area because both prior art references\u00a0disparage and criticize the use of descriptive text. \u00a0The Federal Circuit concluded upon reviewing the references, substantial\u00a0evidence supported the Board\u2019s fact finding that the\u00a0prior art does not teach away from the claimed combination, and therfore affirmed. \u00a0The Federal Circuit disinguished cases like <em>Depuy Spine<\/em>, where the prior art taught that the combination would be inoperative for its intended purpose.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Meirsonne v.
