Capital One Financial Corp.<\/em>, [2016-1077] (March 7, 2017), the Federal Circuit\u00a0affirmed judgment that all claims of U.S. Patent Nos. 7,984,081 and 6,546,002\u00a0ineligible under 35 U.S.C. \u00a7 101, and barring Intellectual Ventures from\u00a0pursuing claims based on U.S. Patent No.\u00a06,715,084. \u00a0The district court granted Summary Judgment of invalidity of the &#8216;081 and &#8216;002 patents, and on the strength of a\u00a0partial summary judgment order of ineligibility under\u00a0\u00a7 101 for the \u2019084 patent in a separate proceeding in New York, granted summary judgment as the &#8216;084 patent under a collateral estoppel theory.<\/p>\n<p>The Federal Circuit observed that the Fourth\u00a0Circuit has established five requirements for collateral\u00a0estoppel: (1) the issue in the prior proceeding be identical, (2) actually\u00a0determined, (3) necessary, (4) final, and (5) that the affected party\u00a0was afforded a full and fair opportunity to litigate the\u00a0issue. However the parties only dispute the finality requirement,\u00a0for which the Fourth Circuit requires a \u201cfinal\u00a0and valid\u201d judgment,\u00a0Intellectual Ventrues arguing that\u00a0the district court erred because it based its collateral\u00a0estoppel findings on a partial summary judgment order, rather than a final judgment. \u00a0The Federal Circuit concluded that under Fourth Circuit law, collateral\u00a0estoppel attaches in light of the partial summary judgment order, because<br \/>\nthis particular issue has reached such a stage that the<br \/>\ndistrict court would see no really good reason for permitting<br \/>\nit to be litigated again.<\/p>\n<p>&nbsp;<\/p>\n<p>The Federal Circuit agreed that the claims of the &#8216;081 and &#8216;002 patents failed step 1 of the Alice\/Mayo test.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Intellectual Ventures I LLC v.
