Broadcom Corp.<\/em>, [2015-1944, -1945, -1946] (January 4, 2017), the Federal Circuit granted Wi-Fi One&#8217;s petition for rehearing en banc to address the question:<\/p>\n<blockquote><p>Should this court overrule Achates Reference\u00a0Publishing, Inc. v. Apple Inc., 803\u00a0F.3d 652 (Fed. Cir. 2015) and hold that\u00a0judicial review is available for a patent\u00a0owner to challenge the PTO\u2019s determination\u00a0that the petitioner satisfied the timeliness\u00a0requirement of 35 U.S.C. \u00a7315(b)\u00a0governing the filing of petitions for inter\u00a0partes review?<\/p><\/blockquote>\n<p>The PTAB&#8217;s decisions applying the one year bar under\u00a0\u00a7315(b) have been inconsistent, and <em>Achates<\/em>\u00a0effectively insulates the misapplication of the bar from review, leaving patent owners without remedy should the Board institute a proceeding that is in fact barred.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In Wi-Fi One, LLC v.
